Details of Settlement Published – $35 Million for Stent Patients

One week ago, the Baltimore Business Journal, reported the details of a settlement previously announced by Jay Miller of Miller, Murtha, & Psoras.  The settlement totaled $35.25 million.  The article states the injured “could receive a total of $35.25 million.”  Nothing in the article indicates anything about what the conditions for that sum to be paid out.

If, in fact, that is the amount, the attorneys fees in the case will amount to just over $14,000,000.

The case involved a heart surgeon giving unnecessary stent implants.  Essentially unnecessary surgeries.

One Baltimore medical malpractice lawyer said to me, upon the launch of InjuryLawyerDatabase, “the stent cases skew the numbers.”  My response was simply, “That’s one way to look at it.  Another way to look at it is the stent cases are the numbers.”  Whatever the specifics, the stent issues involving defendants Mark Midei, St. Joes, Catholic Health Initiatives, and Mid-Atlantic Cardiovascular, were an enormous deal in the Baltimore area.  The news first broke in 2010 and hundreds of people were impacted.

Jay Miller is one of the most active medical malpractice lawyers in Maryland.  He was also quoted in the Daily Record article about InjuryLawyerDatabase.  He said, “They are all the best malpractice lawyers so I can’t criticize it … They also happen to be the top lawyers.  I guess that’s a good thing.  If a consumer would use that site, they couldn’t go wrong.”
