UMMS Corporation Lawsuits in the News
In July 2021, several plaintiffs filed a lawsuit in federal Baltimore district court alleging that UMMS violated fiduciary laws when implementing its retirement contribution plans. The lawsuit, which appears to be pending, maintains that sponsors of the UMMS 401 Defined Contribution plan and the UMMS Voluntary 403 plan failed to provide the most cost-effective and high-performing investment options. The plaintiffs are also accusing UMMS of choosing benefit administrator companies that charged excessive fees and knowingly advised plan participants to invest in “obscenely high fee, chronically underperforming” options that paid kickbacks to the administrator companies.
According to the lawsuit, the plaintiffs lost millions of dollars in retirement funds due to negligence on the part of UMMS in properly vetting and administering its contribution program. The suit also claims that UMMS’ failure to adequately monitor the funds invested by its employees is a violation of the Employee Retirement Income Security Act (ERISA). Established in 1974, ERISA is a federal statute outlining required standards of duty for employee retirement plans to protect investor funds.
